Terms and Conditions
Vartis Technic Limited ("Vartis Technic") is a company registered in Nigeria and offering a range of property maintenance and improvement services ("Services"). In order to complete the Services, we may need to supply/purchase materials/products ("Goods") to be used at the location of where the Services will be carried out ("Site").
These Terms and Conditions ("Terms") govern your access to and use of the Vartis Technic website, products, estimates, quotations, and Services. These Terms constitute a legally binding agreement between you ("Customer," "Client," "you," or "your") and Vartis Technic ("Company," "we," "our," or "us"). Words used in these Terms in the singular, where the context so permits, shall be deemed to include the plural and vice versa.
By accessing our website, requesting a quotation ("Estimate"), placing an order, booking a Service, or engaging Vartis Technic for any work, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, please do not use our website or our Services.

Acceptance of Terms
By using our website or engaging our Services, you confirm that:

You are at least 18 years old or have the legal authority to enter into a contract.

The information you provide is accurate and complete.

You will use our website and Services only for lawful purposes.

You agree to comply with these Terms and all applicable laws and regulations.
PLACING OrderS
You can request for Services via our app, website, email or phone using the contact details stated on our website.
Any communication to us regarding placing orders or following up on any order-related matters should be via phone or email. We do not conduct any business with Customers outside of these channels.
At the point of initially contacting us, you may be given, either verbally or in writing, an initial Estimate of the cost of the Services and any Goods that may be required to complete the Services ("Preliminary Estimate"). Upon further discussion and/or a visit to the Site for an inspection to better understand the work required ("Inspection"), we may provide a revision to the Preliminary Estimate ("Final Estimate").
These Terms will be used together with any Preliminary Estimate or Final Estimate to form an agreement between you and us (the “Contract”). We will provide an expected date/time we will attend the Site to commence the Services. The Contract will become binding on you and us once you accept the fees and terms stated on the Estimate and agree to us attending the Site. You will be deemed to have accepted the Contract if you state so verbally, in writing and/or by making a partial or full payment of the amount indicated on the Estimate.
Any date/time provided by us to you of when we will attend the Site either for an Inspection or to carry out work as part of the Services is only an estimate and we may adjust this as long as we give you as much notice as we possibly can.
Any Estimate (Preliminary Estimate or Final Estimate) is only an estimate and may be subject to change for a variety of reasons. As soon as we expect that a variation to the Estimate may be required, we will notify you and explain why this is so.
At our discretion, we may decide to withdraw an Estimate before a Contract is entered into.
Cancelling OrderS
If you decide to cancel the Contract, you should notify us in writing via email and provide a reason why. If we do not acknowledge receipt of your notice to cancel within one business day of you writing to us, you may assume that your cancellation notice was not received and you may then proceed to contact us via another channel.
For any project lasting more than seven days, the cancellation period will terminate two days after the Contract becomes binding (as defined in Clause 2 above).
In the event that you cancel the Contract, you will still be liable to pay for any Services carried out up until then. You will also be liable to pay for any Goods ordered on your behalf, including Goods ordered but not yet delivered to the Site.
If you are due a refund for any Services not yet carried out or Goods not yet ordered, a refund will be processed within seven business days of us receiving your bank account details. Any refund due to you will only be paid to the same account we received payment from.
If you wish to reschedule a Service, we will consider your request and plan for an alternative time window. However, if the request to reschedule comes less than six hours prior to the start of the time window we gave to attend the Site, you will be liable to pay the mininum call-out fee ("Minimum Call-Out Fee") as well as other related costs (including but not limited to the cost of transporting any Goods to the Site).
If we attend the Site within the agreed time window and we are unable to gain access to the Site (because you are unreachable on phone and/or there is no answer at the door/gate), you will be charged the Minimum Call-Out Fee for that visit as well as other related costs . Any subsequent request to attend the Site will be treated as a new booking with its own fee.
ESTIMATES and Pricing
All Estimates provided by Vartis Technic are based on the information available at the time they are prepared.
Unless otherwise stated:

Estimates are valid for the period specified in the Estimate.

Fees/prices may change if the project scope changes.
-
Additional work requested after approval may result in additional charges.
-
Goods' costs may vary due to supplier pricing or market conditions.
-
A Site Inspection may be required before a Final Estimate is issued.
-
Value Added Tax (VAT) will be added to Fees for Services.
-
Generally, pricing is higher for after-hours/weekend work:
-
Monday - Friday: 5pm - 9am
-
Saturday: All day
-
Sunday: All day
-
Public holidays: All day
-
No work will begin until the Estimate has been accepted and any agreed payment requirements have been met.
Bookings and Appointments
Customers are responsible for providing accurate information when booking Services.
You agree to:

Provide correct contact details.
-
Ensure safe access to the Site.
-
Provide detailed directions to the Site.
-
Notify us of any restrictions to accessing the Site (e.g. closure of street gates or any other curfews, restrictions to the type of vehicles that may access the Site, security protocols, restrictions to days/hours when our work can be carried out, etc).

Make the work area accessible.
-
Inform us of any known hazards before work begins.
-
Properly secure or remove pets/animals from the Site.
We reserve the right to reschedule appointments due to weather conditions, emergencies, equipment failure, staff availability, or other circumstances beyond our reasonable control.
Scope of Work
Only Services expressly stated in the accepted Estimate/Contract will be carried out. Additional requests made after work begins shall be treated as variations and may result in:

Delays
Project completion dates are estimates only. Delays may result from:

Weather conditions

Material shortages
-
Government actions
-
Utility interruptions

Customer changes

Restricted site access

Safety concerns

Events beyond our reasonable control
The Company shall not be liable for reasonable delays arising from such circumstances.
Health and Safety
Our employees and contractors ("Technicians") are committed to maintaining safe work practices.
We reserve the right to suspend work where:

Unsafe working conditions exist.
-
Health risks are identified.
-
Customer behaviour threatens Technicians' safety.
-
Required protective measures cannot be implemented.
-
If you have a 'no-shoe' policy at the Site, our Technicians may not be able to adhere to this if their safety may be compromised.
Customer Responsibilities
To help us deliver our Services efficiently, customers agree to:

Provide accurate information regarding the requested Service.
-
Grant Technicians access to the property.
-
Provide us with free parking space for our vehicle(s).
-
Notify and/or obtain consent from neighbours, landlords, facility managers, estate managers, government agencies or any other relevant parties of the Services to be carried out including but not limited to the length of time it will take and possible noise/disruption the Services will cause.

Remove valuable or fragile items from the immediate work area where appropriate.
-
Obtain any required approvals or permissions before work begins.
-
Notify us of any existing defects or safety concerns.
-
Provide power necessary for us to carry out the Services. If you rely solely on power from the grid, you should make arrangements for an alternative power source that has sufficient capacity to power the electrical tools/machinery that we may use. If you have a generator or solar power, you should confirm that there is sufficient fuel/charge available for us to carry out the Services and that they are powerful enough to power the electrical tools/machinery that we may use.

Provide access to clean water at the Site.

Provide our Technicians access to toilet facilities.
-
If we attend a Site and any of the above listed requirements have not been met, we reserve the right to suspend work and reschedule the work for another date/time at a fresh cost to you.
Failure to meet these responsibilities may affect project timelines or Service delivery.
COMPANY Responsibilities
To help us deliver our services efficiently, we agree to:

Execute the Services diligently and in line with the agreed scope.

Supply Goods that are fit-for-purpose while acknowledging the customer may have been presented with Goods of varying grades/quality before commencing the Services.
-
For routine Services where minimal waste/dirt is generated, we shall tidy up the work area upon completion of the Services - this shall be limited to general cleaning:
-
Picking up litter, sweeping and wiping for any work that does not include water spillage
-
Picking up litter, sweeping, wiping, and mopping for any work that includes water spillage
-
-
For non-routine Services where significant amount of waste/dirt is generated, we will not be responsible for cleaning and/or waste disposal upon completion of the Services. Where anticipated, we may separately include the cost of cleaning and/or waste disposal in your Estimate. If the cost of cleaning/waste disposal is not stated in the Estimate, you will be responsible for arranging and paying for the cleaning and/or waste disposal.

While still at the Site, we may carry out any necessary remedies to defects identified by you in relation to the agreed Services. After completing the Services and leaving the Site, customers will have up to twenty four hours to report any dissatisfaction with the work carried out. After discussing with you and after reviewing any picture and/or video evidence provided by you and we believe there is a reason for us to re-attend the Site, we will communicate a convenient time-window for doing so.

Unless it is unlawful or will cause a safety hazard, we may follow your directive to carry out Services that we object to for a variety of reasons including but not limited to aesthetics, design functionality, efficiency, industry best practice. In such instances, we may notify you of our objection verbally or in writing and will not be liable for any adverse impact as a result of such work.

We will carry out the Services within our normal business hours Monday - Friday (9am - 5pm) unless otherwise agreed or in emergencies.
-
If you supply the Goods to be used for executing the Services, we will not be liable for such Goods or their suitability for the Services.
-
If we believe that it is more prudent to replace rather than repair an item/appliance as part of executing the Services, we will notify you.
-
If we are expected to carry out Services on an item/appliance/area that we believe to be degraded/aged/in poor condition or where we are informed/we observe/we believe a number of repairs have previously been carried out, we may notify you that are further work by us may not have a lasting effect or solve the problem at all.
-
Where any delays are expected, we will notify you with as much notice as reasonably possible.

Where relevant, we may notify you that, in certain instances, executing Services may not completely eradicate the identified problem including but not limited to:
-
Properties in some locations are naturally prone to mould, so even after mould treatment, it may continue to exist and may need to be managed through periodic treatment, proper ventilation and use of a dehumidifier.
-
Some stains may not removable at all or may only be partially removed.
-
Old appliances may not function as well as they used to even after repairs and changing parts.
-
Some electrical problems may continue to occur if the source of the problem is the electrical wiring in the property. If sub-standard wires were used and/or a sub-optimal wiring system was deployed across the property, only a complete re-wiring may solve the problem.
-
Products of different grades/quality may perform differently and may vary in how durable they are. Some materials are generally less durable than others e.g. MDF versus HDF.
-
Air conditioners' cooling ability may be affected by the weather - during hotter weather, they may not cool as well even after being recently serviced/repaired.
-
Customer Property
Customers should remove or secure valuable and fragile items at the Site before work begins.
While reasonable care is taken, Vartis Technic shall not be responsible for:

Items not removed from work areas.
-
Existing structural weaknesses.
-
Pre-existing defects.
-
Hidden utilities not disclosed by the Customer.
Payment Terms
Payment terms will be specified in your Estimate.
Depending on the project, payment may include:
-
Deposit before work begins.
-
Progress payments for larger projects.
-
Full payment before or upon completion.
-
Payment according to agreed milestones.
Late payments may result in delays to ongoing work or suspension of Services until outstanding balances are settled.
Project Changes
If you request changes after work has commenced:

We will assess the additional work.
-
Revised pricing and timelines may apply.
-
Work will proceed only after the revised scope and pricing have been approved where required.
Emergency Services
Emergency response times depend upon:

Technician availability.
-
Traffic conditions.
-
Weather.
-
Accessibility.
-
Nature of the emergency.
While we aim to respond promptly, specific arrival times cannot be guaranteed.
Service Completion
Upon completion, customers are encouraged to inspect the completed Services promptly. If you believe any aspect of the Services does not meet the agreed scope, please notify us within twenty four hours so that we can review the matter. If no notification of dissatisfaction is received within twenty four hours of completion of the Services, we shall assume that you are satisfied with the scope and quality of work and we shall have no further liability to you.
Warranties
Where applicable, Vartis Technic may provide warranties for certain workmanship or Services.
Warranty coverage does not apply to:

Damage caused by misuse or neglect.

Normal wear and tear.
-
Customer alterations after completion.
-
Damage caused by third parties.
-
Natural disasters or events beyond our control.
-
Pre-existing structural defects that were not part of the agreed scope of work.
Any warranty details will be communicated separately where applicable.
Limitation of Liability
To the fullest extent permitted by applicable law:

Vartis Technic will not be liable for indirect, incidental, special, or consequential losses arising from the use of our website or Services.

Our liability for any claim relating to a Service will generally be limited to the amount paid for that specific Service, except where the law provides otherwise.

We are not responsible for delays caused by circumstances beyond our reasonable control, including severe weather, supply chain disruptions, utility outages, government actions, or other force majeure events.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
Intellectual Property
All content on the Vartis Technic website and app, including text, graphics, logos, images, icons, designs, and other materials, is owned by or licensed to Vartis Technic and is protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, modify, publish, or commercially exploit our content without prior written permission.
Confidentiality
Both parties agree to treat confidential information obtained during the course of the engagement with appropriate care, except where disclosure is required by law or necessary to perform the Services.
SOLICITATION
You agree not to solicit our Technicians by:

Making them job offers

Asking them to do work for you privately and without going through the formal Vartis Technic booking process

Inducing them to obtain proprietary information
-
Collecting their private contact details
We reserve the right to immediately terminate any ongoing work, blacklist you as a customer and seek legal redress where these Terms are violated.
TREATMENT OF OUR TECHNICIANS
Our Technicians always strive to please Customers and often go to extra lengths to ensure Customers are fully satisfied with the Service. We expect that our Customers will accord the same courtesy and respect to all our Technicians they may engage with via email, over the phone or in person. While we are patient with Customers, we will not tolerate any written, verbal or physical abuse to our Technicians.
Any breach of these Terms by a Customer may result in our refusal to fulfil the customer’s service request or immediate termination of any ongoing work. We reserve the right to report any incidence of abuse to the appropriate law enforcement authorities.
PHOTOGRAPHY AND VIDEO CONSENT
To showcase our work and Services, Vartis Technic may, capture photographs and video recordings of the Site, completed projects, work in progress, or areas where our Services have been provided. These images and recordings may be used for lawful marketing, advertising, promotional, educational, and business purposes, including on our website, social media platforms, digital and print publications, presentations, brochures, newsletters, and other promotional materials.
By booking our Services or engaging our Services, you grant Vartis Technic a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable licence to use, reproduce, edit, publish, distribute, and display the approved photographs and videos for these purposes without compensation.
We respect your privacy and understand the importance of protecting your personal space. Accordingly, we will make every reasonable effort to avoid capturing identifiable images of you, your family members, guests, or any personal or family photographs, portraits, documents, or other private items displayed within the property. Where such items are inadvertently captured, we will use reasonable efforts to crop, blur, obscure, or otherwise remove them from the final marketing materials whenever practicable.
If you or any member of your household does not wish to appear in any photographs or videos, or if there are specific features, or personal items that you do not want recorded, please notify us at the time of making a booking. We will make reasonable efforts to accommodate your request, provided doing so does not materially affect the documentation of our work.
Nothing in this clause guarantees that incidental or unavoidable background elements can always be excluded; however, Vartis Technic is committed to conducting all photography and videography with due care, professionalism, and respect for your privacy.
You may withdraw your consent for future use of photographs or videos by providing written notice to Vartis Technic. Withdrawal of consent will not affect any materials that have already been published, distributed, or otherwise lawfully used before the withdrawal request was received.
Website Use
You agree not to:

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms or the use of our Services shall be subject to the jurisdiction of the competent courts in Nigeria, unless otherwise required by applicable law.
Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Changes to These Terms
Vartis Technic may update these Terms from time to time. Updated versions will be published on this page with a revised effective date. Continued use of our website or Services after changes are posted constitutes acceptance of the revised Terms.
